Terms of Service
1. Agreeing to these terms
By creating an account (you accept these terms with the checkbox at sign-up) or by using Avail, you agree to these Terms of Service and to the Privacy Policy. You must be at least 13 years old to use Avail. Avail is operated by Dylan O'Carroll ("we," "us").
2. What Avail is
Avail lets you broadcast your availability to friends you choose. The people you share with never see each other, and replies happen in private one-to-one conversations. Avail is free of charge and offered in the United States and Canada.
3. Your account
Your account is tied to your phone number. Keep control of your phone number and devices — you're responsible for what happens on your account. One account per person. Don't impersonate anyone or misrepresent who you are.
4. Your content
What you post — availability posts, place descriptions, messages — is yours. So that Avail can work, you grant us a non-exclusive, worldwide, royalty-free license to host, store, process, transmit, and display your content, solely to operate the service: delivering your posts and messages to the people you chose, and moderating for safety. This license ends when your content or account is deleted, except for the report-evidence retention described in the Privacy Policy.
5. Community rules — zero tolerance
There is no tolerance for objectionable content or abusive behavior on Avail. That includes, without limitation: harassment or bullying; threats of violence; hate on the basis of who someone is; impersonation; spam; sexual content involving minors (reported to authorities, always); and any content that is illegal or that a reasonable person would find seriously objectionable in a private social setting.
How this is enforced:
- Automated filtering screens content when it's posted.
- You can report any user, availability post, or message in the app (press-and-hold a post, or use the buttons on a profile or conversation). Reports are reviewed and acted on within 24 hours.
- You can block anyone — including people you're not friends with — and blocking hides everything in both directions.
- We may remove any content and suspend or terminate any account, at our sole discretion and without notice, for conduct that violates these terms.
6. Ending things
You can delete your account at any time in Settings — it's a real, permanent deletion, described in the Privacy Policy. We may suspend or terminate accounts that violate these terms.
7. Disclaimers
Avail is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose. We don't guarantee the service will be uninterrupted or error-free. Avail is a way to let friends know you're around — it is not an emergency service, and you're responsible for your own judgment about meeting people in person.
8. Limitation of liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of Avail. To the same maximum extent, our total liability for any claim relating to the service is limited to fifty US dollars (US $50). Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.
9. Governing law
These terms are governed by the laws of the State of California, USA, without regard to its conflict-of-law rules. Disputes will be resolved in the state or federal courts located in California, and you consent to their jurisdiction.
10. Changes to these terms
We may update these terms; changes are posted here with a new effective date, and material changes are flagged in the app. Using Avail after a change takes effect means you accept the updated terms.
